Did you know that the federal definition of lobbying is different than the state definition which is different than the NYC definition? And, that the reporting requirements are different as well. Do you know what limitations your funders, particularly government and foundations, place on you? There are two hot topics related to recent changes in employment law that you should know: One is related to providing unpaid field placements for student interns. While this has been a valued resource for many nonprofits and higher education, unless interns fall into a set of criteria that is now aggressively enforced by the US Department of Labor, they are considered employees under the FLSA and entitled to minimum wage, overtime and statuatory benefits. Another recent change relates to your freedom to terminate employees who post critiques of their employers on social media sites. Can you terminate even in our Employment-at-Will state? Perhaps now?
